Confirmation, as below. The recent petition of the prior and convent of the Benedictine priory of Belvoir (de Belvero) in the diocese of Lincoln, immediately subject to the Roman church, and John Appulton, perpetual vicar of the united parish churches of Barkston and St. Helen in Plumgarth in the same diocese, contained that they formerly approached the late William, then bishop of Lincoln, with a view to his uniting the said vicarages, who, alleging himself to be otherwise engaged, remitted the matter to the court of the archbishop of Canterbury; that William Witham, a canon of Lincoln, doctor of laws, dean of the church of St. Mary Arches (de Arcubus), London, commissary appointed by John,
archbishop of Canterbury, in consideration of the slenderness of the fruits etc. of both churches, [value not stated,] and their being so near that they could be served by a single vicar, united in perpetuity the vicarage of St. Helen's to Barkston, the latter to be the mother church, under certain conditions [stated], e.g. if the nave of St. Helen's should for want of repair fall into ruin the said prior and convent should arrange its chancel as a chapel (fn. 5) and cause [mass and other divine offices] to be celebrated by a chaplain once a week and on certain feast days, the manse and glebe (fn. 6) of St. Helen's being reserved to the said prior and convent for the conservation of the said chapel, etc.; and that subsequently the said prior and convent and vicar agreed to pay yearly, by way of compensation, to the bishop of Lincoln 6s. 8d. and to the archdeacon of Leicester 3s. 4d.; in virtue of all which the said John obtained possession of St. Helen's, on its voidance, and still holds it together with the said mother church. To the bishop of Brechin, the abbot of Cupar in the diocese of St. Andrews and the vidame of Reims. Mandate, as below. The pope has learned that the chapel of St. Mary within the cemetery of the parish church of Forgondeway [sic] in the diocese of Dunkeld (which is of lay patronage, and whose foundation provides that no one can hold it unless in priest's orders and that its holder cannot hold another benefice therewith, and which James Cameron [now] a canon, sometime abbot of Holyrood, Edinburg, was holding in commendam by papal authority at the time of his promotion to the said monastery, made by the same authority) became and is at present void, or that the said commenda thereof ceased, by the said promotion and abbot James's subsequent obtaining possession of the administration etc.; that its collation lawfully devolved by the Lateran statutes to the apostolic see, although Patrick de Forsyth, clerk, of the said diocese, under pretext of his presentation by the patron and his institution as rector by the late James, bishop of Dunkeld, for some time unduly detained possession, without being promoted to the priesthood and together with another benefice; and that, after the death of the said bishop James and the removal of the said Patrick by bishop John (to whom provision was made by papal authority), Thomas de Kirchtone, priest, of the said diocese of St. Andrews, was in like manner presented by the patron to the said bishop John, and by him instituted as rector, and has unduly detained possession for more than a year, but less than two
years, after the said lapse, taking the fruits. The pope therefore orders the above to collate and assign to John Donaldi, a canon of Dunkeld, bachelor of canon law, a priest, the said chapel, without cure and value not exceeding 6l. sterling, whether it became void as above, or be still void because it was granted in commendam to the said abbot James, or became void by the resignation of the said Patrick or Thomas, or in any other way, removing the said Thomas and any other unlawful detainer. Mandate to collate and assign to John Donaldi, perpetual vicar of Ouch[t]irgawin in the diocese of Dunkeld, bachelor of canon law, a priest, the chancellorship of Dunkeld, a non-major dignity, value not exceeding 8l. sterling, void by the death of Richard de Clepham; whether it be so void, or by the death of Nicholas de Atholia, priest, of the diocese of Dunkeld, doctor of canon law, or by the resignation of John de Atholia, priest, of the said diocese, or of the said Richard, or be void in any other way; notwithstanding that he holds the said perpetual vicarage, value not exceeding 8l. sterling, and that the pope lately, motu proprio, made him provision of a canonry of Dunkeld and another of Aberdeen with reservation of as many prebends and of a dignity etc. of one of those churches, and [reservation] of a benefice with and (et) without cure, wont to be assigned to secular clerks, even if a rural deanery or an archpriestship, in the collation etc. of the bishop and the prior and chapter etc. of St. Andrews, and dispensed him, by other letters, to hold two incompatible benefices for life. about eight years ago and consummated, begetting offspring, in ignorance of an impediment of relationship in the second degree of affinity arising from the fact that William had several times committed fornication with a certain Isabella Morton, related to Cecily in the second degree of kindred, and had offspring by her. To Robert Cady, rector of Line in the diocese of Glasgow. Grant, as below. The pope recently ordered provision to be made to him of a canonry of Glasgow and the prebend of Cardross therein, void by the death of Richard Clephan, whereof, as his recent petition contained, John, bishop of Penne, one of the executors of the said mandate, made to him collation and provision. Seeing that John Donaldi, priest, of the diocese of Dunkeld, to whom the pope also recently granted provision of the same [above, f. 244], has this day resigned to the pope, by his proctor, Alphonso Alvari, archdeacon of Calahorra (Calaguritan.), the said grant (the letters whereof have not been drawn up) and all right in and to the said canonry and prebend, the pope grants to the above Robert (who is an abbreviator of apostolic letters and a subdeacon, and holds the above rectory, value not exceeding 15l. sterling), that the said mandate and collation and provision and their consequences shall hold good from the present date, even if the said canonry and prebend, value not exceeding 15l. sterling, be still void by the said death, or be void by the resignation of the said Richard, or in any other way, etc. Vite etc. (Poggius. | xvi. To Edmund, bishop of Meath. Dispensation, as below. Lately, after the pope had made provision to him of the church of Meath, he granted him to hold therewith for five years in commendam, even after his consecration etc., the parish church of St. Patrick, Trym, in the diocese of Meath, which he was holding at the time of the said provision. At his recent petition—containing that Philip Narreys (rectius
Norreys), priest, was presented by king Henry (to whom, in the absence of such commenda, which was then not known in those parts, the presentation belongs) to the said bishop
(also ignorant of the pope's said grant) for institution to the said church, as being void by the said promotion, that the bishop instituted him, that in virtue of such presentation and institution Philip obtained and is still in possession, and that the bishop has no hope of recovering from him, on account of the favours which he enjoys, the said church within the said period—the pope hereby dispenses the said bishop, who has been consecrated and is in possession of the rule and administration, to hold in commendam, as above, the said church of Trym, value not exceeding 120 marks sterling, if he obtain it in peace, for five years from the time thereof, and, if he resign it or do not obtain it, to hold any other benefice with or without cure, secular or regular of any order, of any value, even if elective, provided that it be not a claustral office or a conventual priory, even if it be of his collation or presentation, likewise for five years, Personam tuam.
