(f. 215d.)		 To the abbot of Dere in the diocese of Aberdeen. Mandate to collate and assign to Thomas de Tulach, canon of Ross, by both parents of noble birth, the deanery of the same church, a major elective dignity with cure, value not exceeding 30l. sterling, void by the death of William Fau'har, and reserved under the pope's general reservation of all major cathedral dignities; notwithstanding that Thomas (who was lately dispensed by papal authority to hold for life the archdeaconry of Caithness, which is a non-major dignity with cure, and one other [in]compatible benefice, or, if he resigned the archdeaconry, to hold two other incompatible benefices, even if one or both had cure etc., and to resign them, simply or for exchange [above, p. 79]) still holds the said archdeaconry and a canonry of of Moray with the prebend with cure of Croy, and a canonry of Ross with the prebend of Kyrkmichael, value not exceeding 20l., 16l., and 8l. sterling respectively, and that the present pope lately made provision to him of a canonry of Aberdeen and another of Dunkeld, with reservation of as many prebends, and of a dignity etc. even if elective and with cure, of one of them, in virtue of which he accepted, caused provision to be made to him of, and at present holds, a canonry of Aberdeen with the prebend called Banchori Deveny therein, value not exceeding 20l. sterling. Upon obtaining the said deanery he is, as he has offered, to resign the said canonry and prebend of Ross and whichever he prefers of the said prebend with cure and archdeaconry, and the said letters shall be null as far only as regards a dignity, personatus with cure, administration or office.Dignum etc. (An. and Cyprianus. | An. xxx. (f. 265.)		 To the bishop of Clogher. Mandate—the pope having learned that Matthew Magra, [now] a canon, sometime abbot, of SS. Peter and Paul's, Armagh, O.S.A., resigned, and that Maurice Olucheyran, a canon thereof (under pretext of a provision, which was null, made to him by the ordinary when he was excommunicate, of the said monastery, alleged to be void by the deprivation, made by authority of the ordinary, of the said Matthew) has unduly detained possession for about a year and a half—if he find that the said resignation was lawful, to admit it by papal authority, for this time only, and make provision of the said monastery, value not exceeding 20 marks, to John Ocondalaich, a canon thereof, the son of a priest professed of the said order and an unmarried woman, who on account of the said Maurice's power has no hope of obtaining justice in the city or diocese of Armagh; whether it be void as above, or by the said deprivation, or in any other way. John has hereby indult to be blessed by the above or any other catholic bishop, who, after blessing him, is to receive his oath of fealty and send it to the pope as usual; and is hereby specially dispensed to hold and administer the said monastery, notwithstanding the said defect etc. Solicite considerationis indaginem. Lib. 1.’ A flyleaf has the contemporary notes: ‘Primus de beneficiis, prebendis, prebendis et dignitatibus. de dignitatibus vacantibus, et prouisionibus prelatorum Anno vio Eugenii pape IIII’ (which occurs also almost verbatim on the bottom edge of the volume), ‘Conradus die 17 mensis Augusti’ and ‘Rubricatus per Conradum Ciremberg.’
2 Regi Francorum. In the translation which immediately precedes the above in the Register, namely of John, bishop of Amiens, to Térouane, the pope mentions the name of the ‘Rex Francorum,’ viz. ‘Carolo Regi Francorum Illustri.’
3 The usual letter to Henry, king of England, is not given. The provision is not in the Bullarium Pradicatorum nor in Hibernia Dominicana.
