A Message was brought from the House of Commons, by
George Clerke Esquire and others; who brought up Two
Bills:
1. "An Act to enable Trustees to sell the Lands of
Tanfield Mulso Esquire, late deceased, for Payment of his
Debts, and making Provision for his Children;" to which their Lordships
Concurrence is desired.
A Bill returned, concerning Sir Trevor
Williams; to which the Commons agree without any Amendment.

vice lecta est Billa, "An Act to enable Thomas Plator Gentleman to sell Lands, for Payment of Debts
charged upon the same, and reimbursing him such Sums of Money as he hath or
shall lay out, in repairing the Breaches made by the Inundations of the Sea,
and keeping the Water out."
ORDERED, That the Consideration of this Bill is committed
to the same Committee as Sir Thomas Cave's Bill
is.
Lady Zouch versus Nayler.
Upon reading the Petition of Dame Katherine
Zouche, praying, "That Sarab Nayler may be
enjoined to put in an Answer to the Petition of the said Dame Katherine Zouch presented to this House in February 1673;" as also upon reading and considering of the
Judgement of this House given upon the Appeal of Sir Allan
Zouch deceased, and the said Dame Katherine then
his Wife, on the 22th Day of November, 1670:
It is thereupon ORDERED, by the Lords Spiritual and
Temporal in Parliament assembled, That the Petition of the said Dame
Katherine Zouche read this Day be, and is hereby,
dismissed.
Payne versus Wallis.
Upon reading the Petition of John
Payne and Sarah his Wife, being an Appeal from the
Dismission of their Bill of Review, in the Court of Chancery in Hillary Terme last, concerning the Real and Personal Estate of
Sarah Wallsall, Grandmother to the Petitioner
Sarah, and other Matters in the said Petition set forth;
and praying that Elston Wallis and Sarah his Wife, in the said Petition mentioned, may be enjoined
to make Answer thereunto:
It is thereupon ORDERED, by the Lords Spiritual and
Temporal in Parliament assembled, That the said Elston
Wallis and Sarah his Wife may have a Copy of the
said Petition, to which they are hereby required to put in an Answer in Writing
within One Week next after Notice given them by the Service of this Order on
them.
Heywood, E. of Derby's Servant, Privilege.
Upon reading the Petition of the Earl of Derby; shewing, "That, contrary to the Privilege belonging to
the Peers of this House, James Chectham, of
Turton, in the County of Lancaster,
Esquire, did on the Fourth Day of May last, cause
Robert Heywood Esquire, his Lordship's Servant, to be
arrested, by Jeremy Ainsworth, of Tottington, Richard Aspinall of Bury, Bryan
Fawcett John Pilkinton, and Charles Hardman, all
of Turton, and John Bury and
Abell Turner of Bamford, and
detained him Prisoner, refusing to give Obedience to his Lordship's Letter of
Privilege, writ, and made known unto them and to Mr. Richard
Chew Deputy Sheriff of the County of Lancaster, on
the Behalf of the said Robert Heywood; and that the said
James Cheetham uttered contemptuous Words against the
Privilege claimed by the said Earl of Derby;" which
Matters being proved by Oath made at the Bar by Thomas
Hodgkinson and Robert Litchford:
Cheetham, Chew, & al. to be attached, for arresting him.
It is thereupon ORDERED, by the Lords Spiritual and
Temporal in Parliament assembled, That the Serjeant at Arms attending this
House, or his Deputy or Deputies, shall forthwith attach the Bodies of the said
James Cheetham, Richard Chew, Jeremy Ainsworth, Richard
Aspinall, Bryan Fawcet, John Pilkinton, Charles Hardman, John Bury, and
Abel Turner, and bring them in safe Custody to the Bar of
this House, to answer for their said Offences; and this shall be a sufficient
Warrant on that Behalf.
To Sir George Charnock Knight,
Serjeant at Arms attending this House, his Deputy and Deputies, and to all
Mayors, Sheriffs, Bailiffs, Constables, and other His Majesty's Officers, to be
aiding and assisting in the Execution hereof.
Bill to prevent Minors clandestine Marriages.
The House was adjourned into a Committee, during Pleasure,
to consider of the Bill for disabling Minors to marry, without Consent of their
Parents or Guardians, &c.
The House being resumed;
The Lord Privy Seal reported, "That the Committee have
proceeded in the Consideration of the said Bill against Minors marrying without
Parents Consent, and desire the House would appoint another Day to debate
further thereof."
And the House appointed Friday the
21 of this Instant June, to resume the Debate
hereof.
