PRAYERS.
Lords take the Oaths.
This Day these Lords following took the Oaths of Allegiance
and Supremacy, and made and subscribed the Declaration, in Pursuance of the Act
for the more effectual preserving of the King's Person and Government, by
disabling Papists from sitting in either House of Parliament:

King's Answer, concerning Payment of 100£. to Oates;
The Lord Viscount Newport reported,
"That the Lords with White Staves have attended His Majesty, with the Desire of
this House, That He would be pleased to give Order for the speedy Payment of
One Hundred Pounds to Tytus Oates, out of His Majesty's
Treasury; and His Majesty's Answer is, That He had given Order for it."
and concerning Col. Fitz Patrick.
The Lord Privy Seal reported, "That himself, the Earl of
Essex, and the Earl of Burlington,
had attended His Majesty, from this House, and presented their humble Desire,
that Colonel Fitz Patrick, now in Ireland, may, by His Majesty's Order, be commanded to repair
forthwith to his own House there, and not to come within Twenty Miles of
Dublin, or of any other Place (except his own House),
where the Lord Lieutenant of Ireland shall at any Time
reside, till further Order: And His Majesty is pleased to give this Answer,
That he had given Order therein."
List of Papists in Lincoln's Inn.
The Lord Privy Seal acquainted the House, "That the
Society of Lyncolnes Inne have prepared a List of the
Names of such Papists as are of their Society; and have desired his Lordship to
present the same to this House."
King's Answer, concerning Persons breeding up their Children
Papists.
The Lord Viscount Newport reported,
"That the Lords with White Staves have attended His Majesty, with the humble
Desire of this House, That all such Persons who breed or suffer their Children
to be bred up in the Popish Religion may, by His Majesty's Order, be put out of
all public Employments, Civil and Military whereof they are now possessed; and
that for the future no such Persons, nor any Person, shall be put into, or
continued in, any public Employment, Civil or Military, who shall knowingly
marry a Papist. And His Majesty is pleased to grant it."
E. Danby's Attainder Bill.
The House was put into a Committee, to consider of the
Bill for the Attainder of Thomas Earl of Danby, of High Treason.
And, after Debate thereof, the House was resumed.
The Earl of Bridgewater reported,
"That the Committee of the House have been in Consideration of the Bill for the
Attainder of Thomas Earl of Danby
of High Treason; and have made some Amendments and Alterations therein, which
are offered to the Consideration of the House."
And being read Twice, it is ORDERED, That this House
agrees with the Committee in these Amendments.
Oakley discharged.
Upon Report made from the Lords Committees for examining
Matters relating to the late horrid Conspiracy, "That, upon the Petition of
Thomas Oakley, a Prisoner in The King's
Bench, by Order of this House of the 4th of December last, for refusing to take the Oath of Allegiance,
their Lordships have examined his Case; and find that he is a very aged and
illiterate Man, and in great Misery through Poverty, and is no Popish Priest;
and that he is ready and willing to take the said Oath:"
Which being offered to the Consideration of this House, it
is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament
assembled, That the said Thomas Oakley be, and is hereby,
discharged from his present Imprisonment for the Cause aforesaid; and this
shall be a sufficient Warrant on that Behalf.
To the Marshal or Keeper of the Prison of The King's Bench, his Deputy and Deputies, and every of
them.
L. Windsor, excused.
This Day Savage Jackman and
George Mathewes deposed, upon Oath, at this Bar, "That
the Lord Windsor was so sick of an Ague, that they
believed he could not come to attend this House at this Time without Danger of
his Life."
And so the House excused him.
E. of Rochester's Privilege:
Whereas Luke Hemyngs was, by Order
of this House, committed to the Gentleman Usher of the Black Rod, for arresting
William Clarke, owned by the Earl of Rochester, a Peer of this Realm, to be his menial Servant (now
Sitting the Parliament) contrary to the Privilege of Parliament:
Hemings discharged.
It appearing this Day, by the Lord Viscount Newport, "That the said Luke Hemyngs hath
made his Submission for his said Offence to the Earl of Rochester, who is willing he should be released;" it is
ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the
said Luke Hemyngs be, and is hereby, discharged from the
present Restraint he is under for his said Offence, paying his Fees; and this
shall be a sufficient Warrant on that Behalf.
