Macclesfield versus Macclesfield.
Upon hearing Counsel this Day, at the Bar, upon
the Petition and Appeal of Ralph Macclesfeild Gentleman Appellant, against Mary Macclesfeild Widow, and
Peter Macclesfeild Gentleman, Respondents, from Two
Dismissions in the Court of Chancery before and on
the Eight and Twentieth Day of January, 33° Caroli
Secundi; as also upon the Answers of the said Mary
Macclesfeild and Peter Macclesfeild put in thereunto:
After due Consideration had of what was offered thereupon, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said
Petition and Appeal of Ralph Macclesfeild shall be, and
is hereby, dismissed this House; and that the Dismissions
from which he appealed shall be, and are hereby, affirmed: And it is further ORDERED, That the Appel
lant do pay the Respondents Mary Macclesfeild and Peter
Macclesfeild Twenty Pounds, for their Costs sustained
in defending the said Appeal in this House.
Sir Simon Leach versus Thompson.
After hearing Counsel this Day, upon the Petition
of Sir Symon Leach, as also Counsel for Mr. Charles
Leach:
It is ORDERED, by the Lords Spiritual and Temporal
in Parliament assembled, That the said Petition of Sir
Symon Leach shall be dismissed this House; it not being
the Intention of this House, in their late Judgement, to
preclude the Parties from trying their Title at Law
upon any other Point than the Validity of the Surrender without Acceptance of the Party to whom it was
made.
Jones versus Beaw.
Upon reading the Petition of John Jones Doctor of
Laws; praying, amongst other Things, "that a Protection
given by the Lord Bishop of Landaffe to William Beaw
may be discharged:"
It is ORDERED, by the Lords Spiritual and Temporal
in Parliament assembled, That the said Petition shall
be, and is hereby, referred to the Lords Committees for
Privileges, to hear such Persons concerning the same as
they shall think fit; whereof the Petitioner is to cause
Notice to be given to the said William Beaw; which
Committee is to meet on Monday next, at Four of the
Clock in the Afternoon.
Hastings versus Seymour's Bill.
ORDERED, by the Lords Spiritual and Temporal in
Parliament assembled, That Counsel shall be heard, on
Saturday next, at Ten of the Clock in the Forenoon,
for Ralph Hastings Esquire, against the Bill, intituled,
"An Act for the better Assurance of the Manor of
Woodlands and Hundred of Knowlton unto Edward
Seymour Esquire;" as also Counsel for the Bill.
Englefyld versus Sir C. Englefyld.
Upon reading the Petition of Anthony Englefyld
Esquire, late Appellant in this House; praying the Direction of this House to the Court of Chancery, to restore him to the Possession of the Premises in Question:
It is ORDERED, by the Lords Spiritual and Temporal
in Parliament assembled, That the Court of Chancery
do direct the Possession thereof to be delivered to
the Petitioner, in Execution of the Judgement of this
House.
