Yorke is added to all Committees that have been named
this Session, or shall be.
Lord Fitzwater, Precedency.
The Earl of Essex reported, "That the Committee
for Privileges have heard the Counsel of the Lord
Fitzwater, who hath claimed Precedency in Parliament, by virtue of a Writ of Summons, bearing Date
the 31th of August, in the 23 Year of Edward the
First, and produced several sworn Copies of Records
to prove his said Claim. And it being demanded what
Place in the House of Peers he pretended unto; the
Counsel answered, That he claimed Precedence of all
Barons now sitting as Barons, particularly of the Lord
Abergavenny, and alledged a Determination in Henry
the VIIIth's Time, whereby he was placed next below
the Lord Clifford.
He said, "He was also, by Order of the Committee,
to acquaint their Lordships, that the Earl of Berks,
in Behalf of the Duke of Norff. as Lord Mowbray;
and his Lordship on Behalf of the Earl of Northumberland as Lord Percy; and the Earl of Norwich
on Behalf of the Lord of Abergavenny now under
Age; the Lord Awdley and the Lord Berkley for
themselves; did desire to be heard what they could
object against the Records; and this was desired more
particularly by the Lord Berkley."
Upon Consideration hereof, it is ORDERED, by the
Lords Spiritual and Temporal in Parliament assembled,
That the Counsel of the Lord Fitzwater shall be heard,
at the Bar of this House, to set forth his Lordship's
Claim, on Tuesday the 22th Day of this Instant March,
at Ten of the Clock in the Forenoon; and that such
Lords as shall oppose his said Claim may be then heard
in the House; and such further Time given them as the
House shall think fit.
Portbury versus Ledgingham, in Error.
The House being moved to give Directions concerning a Writ of Error depending in this House in the last
Sessions, between Roger Portbury and Warwick Ledgingham:
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That it be referred to the
Committee for Privileges, to search and examine Precedents concerning this House proceeding upon Business
depending and left undetermined in a former Session of
Parliament, and make Report thereof to this House; and
that such Judges as their Lordships shall appoint may attend them concerning this Matter.
