THIS Day, before the Sitting of the House, the Lord whose Name is underwritten did, in the Presence of the Lord Privy Seal and others of His Majesty's Privy Council, kneeling at the Woolsack whereupon the Lord Keeper sits, take the Oath of Allegiance provided and mentioned in the Parliament 3° Regis Jacobi.

The Gentleman Usher of the Black Rod held the Bible, and the Deputy to the Clerk of the Parliament read the Oath.

E. Carlisle, Privilege.

Whereas Ezekiell Linke being this Day brought to the Bar as a Delinquent, for uttering very scandalous Words against the Earl of Carlile, a Peer of this Realm, hath there acknowledged his said Offence, and Sorrow for the same, and begged Pardon of this House, and hath likewise submitted himself to the said Earl of Carlile for Forgiveness:

Linke related.

It is ORDERED, by the Lords Spiritual and Tempoporal in Parliament assembled (at the special Instance of the said Earl of Carlile on his Behalf), That the said Ezechiell Linke (who hath now received the Reprehension of this House) be, and is hereby, discharged from any further Restraint for his said Offence (paying his Fees due to the Officers of this House); and this shall be a sufficient Warrant on that Behalf.

Baker versus Warden, in Error.

Whereas, by virtue of His Majesty's Writ of Error returnable into the House of Peers in Parliament assembled, a Record of the Court of King's Bench was brought into this Court on the Three and Twentieth Day of January last (with the Transcript thereof), wherein Judgement is entered for David Warden, against John Baker; upon which Writ Errors being assigned and Issue joined, and a Day given to hear the said Errors argued at the Bar, the said David Warden appearing by his Counsel, but the said John Baker not appearing, nor any Counsel for him:

It is thereupon Resolved and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Judgement of the Court of King's Bench, given for the said David Warden against the said John Baker, be, and is hereby, affirmed; and that the said Transcript of the said Record of the Court of King's Bench, wherein Judgement is entered as aforesaid, be remitted; and that he the said David Warden may thereupon proceed as if no such Writ of Error had been brought into this Court: And their Lordships do further Adjudge, That the said John Baker shall pay unto the said David Warden the Sum of Ten Pounds for his Costs, by reason of his bringing the said Writ of Error into this Court, and not prosecuting thereof.

The Tenor of which Judgement, to be affixed to the Transcript to be remitted, followeth; videlicet,

"Postea, scilicet, Vicesimo Tertio Die Januarii, Anno dicti Domini Regis Vicesimo Quinto, Transcript. Record. & Processus prædict. cum omnibus ea tangentibus, Prætextu cujusdam Brevis Domini Regis de Errore corrigend. per præfatum Johannem Baker in præmissis prosecut. dicto Domino Regi in præsenti Parliamento apud Westm. a prædicta Curia dicti Domini Regis hic transmiss. suit; prædictusque Johannes Baker, in eadem Curia Parliamenti comparens, placitavit, quod per Recordum prædictum apparet quod Judicium prædictum in Placito prædict. (fn. *) reddidit suit pro prædict. David. versus ipsum Johannem, ubi per Legem Terræ hujus Regni Angliæ Judicium illud reddi debuisset pro prædicto Johanne, versus ipsum David. ideoque manifeste est Erratum; ad quod prædict. David Warden, in eadem Curia Parliamenti prædicti comparens, placitavit, quod nec in Recordo & Processu prædict. nec in Redditione Judicii prædicti in ullo est Erratum; super quo Dies dat. suit per Curiam Parliament. prædict. præsat. Johanni Baker, ad audiend. Errorem in Recordo & Processu prædict. assignat. usque Decimum Diem Februarii, Anno dicti Domini Regis nunc Vicesimo Sexto; idem Dies dat. suit præfat. David. Warden: Ad quem Diem in eadem Curia Parliamenti apud Westm. prædict. venit prædict. David Warden, & prædict. Johannes Baker (licet solemniter exactus) non venit, nec est Breve suum de Errore ulterius prosecut.; propter quod consideratum est per Curiam Parliamenti prædicti, quod Record. prædict. nec non Process. prædict. a Curia Parliamenti prædicti, prædicto Decimo Septimo Die Februarii, remittentur, et quod prædict. David. Warden in Curia dicti Domini Regis coram ipso Rege haberet inde Executionem versus præsatum Johannem Baker, juxta Formam & Effectum Judicii prædicti, dict. Brevi de Errore ac Process. superinde habit. in aliquo non obstante; et ulterius per eandem Curiam Parliamenti prædicti consideratum est, quod prædict. David Warden recuperet versus præfat. Johannem Baker Decem Libras, eidem Davidi pro Misis & Custagiis suis quæ sustinuit Occasione Dilationis Executionis Judicii prædicti Prætextu Prosecutionis prædicti Brevis de Errore; ac superinde Record. & Process. præ. Curiæ dicti Domini Regis per Curiam Parliamenti prædicti coram dicto Domino Rege ubicunque, &c. remittentur, & in eadem Curia dicti Domini Regis coram ipso Rege jam resident. &c."

Securing Ireland.

ORDERED, That this House be adjourned into a Committee To-morrow Morning, at Ten of the Clock, to take into Consideration the securing of the Kingdom of Ireland.

ORDERED, That this House do sit in the Afternoon To-morrow, to hear the Cause between Darrell and Whitchcott.

Dawson versus Jeaffreson, in Error.

Whereas, by virtue of His Majesty's Writ of Error, returnable into the House of Peers in Parliament assembled, a Record of the Court of King's Bench was brought into this House on the 26 Day of March last past (with the Transcript thereof), wherein Judgement for John Jeaffreson, against Richard Dawson, is entered:

Upon hearing of Counsel on both Parts at the Bar, to argue the Errors assigned by the said Richard Dawson; after due Consideration had of what hath been offered on either Part thereupon, it is Resolved and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Judgement of the Court of King's Bench given for the said John Jeaffreson, against the said Richard Dawson, be, and is hereby, affirmed; and that the said Transcript of the said Record, wherein the Judgement of the Court of King's Bench is entered as aforesaid, be remitted; and that the said John Jeafreson may thereupon proceed as if no such Writ of Error had been brought into this Court.

Johannes Jeaffreson in Curia dicti Domini Regis coram ipso Rege haberet inde Executionem suam versus præfatum Ricardum Dawson, juxta Formam & Effectum Judicii prædicti; ac superinde Record. & Processus prædict.
