Ld. Mohun's Privilege.
The Marquis of Dorchester reported from the Committee of Privileges, "That the Opinion of the Committee was, That the Lord Mohun was sued by Mean
Process, contrary to the Privileges of the Peers."
It is Ordered, That this Cause shall be heard, at
this Bar, on Monday Morning next, by Counsel on both
Sides; and the Sheriff to bring Billing a Prisoner at
the same Time, to give in his Testimony.
M. of Newcastle's Bill.
Hodie 1a
vice lecta est Billa, "An Act for restoring
unto William Marquis of Newcastle all his Honours,
Manors, Lands, and Tenements, in England, whereof
he was in Possession on the 23th of October, 1642, or
at any Time since."
Ld. Poulett's Bill.
Hodie 1a
vice lecta est Billa, "An Act for restoring
to John Lord Poulett, and his Heirs, certain Messuages
and Lands, in the County of Dorsett."
M. of Worcester's Bill to be brought in.
Ordered, That the Marquis of Worcester hath Leave
to bring in a Bill, for restoring him to his Estate, as
other Lords have.
M. of Newcastle's Order.
Ordered, That the Marquis of Newcastle shall have
the Benefit of the same Order as other Lords have had,
for restoring them to their Estates.
Bill of Indemnity.
The House was adjourned into a Committee during
Pleasure, to proceed further in Consideration of the Bill
for Indemnity.
The House being resumed;
The Lord Robertes reported, "That the Opinion of
the Committee was, That Four Persons, who sat upon
the Trial of the Earl of Derby, Earl Holland, Earl
Cambridge, and the Lord Capell, shall be totally
exempted out of the Bill of Indemnity."
Four Persons excepted.
That those Four Persons are, John Blackwell, Colonel
Croxton, William Wyberd, and Edmond Waringe.
The Question being put, "Whether to agree to
the Report of the Committee?"
It is Resolved in the Affirmative.
Ordered, That the aforesaid Four Persons be secured forthwith.
Message from H.C. with the Poll Bill; and to remind the Lords of others.
A Message was brought from the House of Commons,
by Arthur Annesley Esquire, &c.; who brought the Poll
Bill up, formerly sent down to the House of Commons,
with Amendments and Alterations, with Observations
thereupon.
2. To put their Lordships in Mind of several Bills of
Public Concernment as lies before their Lordships undispatched, wherein they desire their Lordships to give
Expedition.
Ld. Mohun versus Keigwin and Dandy.
Upon Report this Day to the House, by the Marquis
of Dorchester, from the Committee of Privileges, "That
the Lord Mohun was sued by Mean Process, contrary
to the Privileges of Peers:"
It is Ordered, by the Lords in Parliament assembled,
That the Cause of the Lord Mohun, against Will. Keigwyn and Thomas Dandy, shall be heard, at this Bar, on
Monday the 13th of this Instant August, at Nine of the
Clock in the Morning; and all Parties are to have timely Notice, who are then to attend the said Hearing accordingly; and that the Sheriff of Midd. or his Assigns
shall bring the Body of Billing at that Time, to
testify his Knowledge in the said Cause.
Order for restoring the M. of Newcastle to the Possession of his Estate, &c.
Upon Information given this Day to the House, "That
the Lord Marquis of Newcastle hath had his Estate
Real and Personal illegally sold and disposed of, by a
late unlawful and usurped Authority, without Hearing,
Summons, or Proof of any Charge or Crime alledged
against him, contrary to the fundamental Laws of the
Land, and Privilege of Peerage and Lords of Parliament;" and forasmuch as it is also informed, "That
the Purchasers have reimbursed themselves with great
Advantages the Monies they paid for the Land and
Premises so illegally purchased, and that the Lord
Marquis is content to release all the Arrears of his
Lands so sold, unto the Five and Twentieth of April,
1660:"
It is Ordered, by the Lords in Parliament assembled,
That the Possession of all the Houses, Lands, Woods
and Timber, belonging or appertaining to the said Lord
Marquis, shall forthwith be delivered unto his Lordship
or his Assigns; and if any Opposition be made, then the
several Sheriffs, Bailiffs, in the respective Counties and
Places where they be and remain, shall be aiding thereunto: And hereof all whom this shall any Ways concern
are to take Notice, and give their Obedience accordingly.
