Absence of the Lord Chancellor in regard of
his ill Health.
Briscoe's Bill.
This Day the Counsel and Witnesses of the Lady
Rosewell and Ellen Brisco Widow were heard, at this
Bar, upon the Matter contained in the Bill to empower
Sir John Drake Knight and others to make Sale of
Lands, for Payment of the Portion of Ellen Briscoe
Widow.
Lady Rosewell heard, concerning it.
And, upon Consideration and Debate of what had
been said at the Bar,
The Question being put, "Whether this Bill shall
be committed?"
It was Resolved in the Affirmative.
ORDERED, That the Consideration of this Bill is

Their Lordships, or any Five; to meet on Tuesday
next, at Three of the Clock in the Afternoon,
in the Prince's Lodgings.
Lodington, E. of Warwick's Servant, Privilege.
Upon Complaint made to this House, and upon Oath
made at this Bar, "That Thomas Lodington, a menial
Servant to the Earl of Warwick, a Peer of this Kingdom (and owned by his Lordship to be so), was arrested, immediately upon the last Adjournment of
the Parliament, at the Suit of Samuell Atkins Merchant, who not only encouraged the Keeper of the
Prison of St. Katherin's to detain him, but promised
to save him, and in case that the said Keeper should
be laid by the Heels for the same, he would lie by
him; and further, that the said Atkins did speak
slighting Words of the Earl of Warwick, saying,
That he would come to a Trial with his Lordship
concerning his Privilege:"
To which Charge the said Samuell Atkins, by his Petition, confessed, "That he, being informed that the said
Thomas Lodington was arrested upon several Actions,
and that he was a Prisoner, did lay an Execution upon
him for a Debt of Two Hundred and Three Pounds."
Hereupon it is ORDERED, by the Lords Spiritual
and Temporal in Parliament assembled, That the said
Thomas Lodington, being arrested contrary to the Privilege of Parliament, and detained in Prison by
Neale, Keeper of the Prison at St. Katherine's, shall be
forthwith released from his present Restraint; and that
the further Consideration of the Criminal Part of this
Business is referred to the Examination of the Committee of Privileges; before whom the said
Neale, that first arrested the said Thomas Lodington, shall
upon Summons appear before the said Lords Committees,
to answer the said Offence; and afterwards their Lordships are to make Report to this House.
