Hodie 1a

Hodie 1a

Grimes & al. for arresting Herbert, E. of Midd's Servant.
Next, Francis Grimes Under Sheriff of the County
of Warwick, and Thomas Meade his Deputy, and Thomas Rownd Bailiff, were brought to the Bar, as Delinquents, being attached for arresting Danyell Herbert,
menial Servant to the Earl of Midd. contrary to the
Privilege of Parliament.
And they pleaded, "That they did not know the said
Danyell Herbert to be Servant to the Earl of Midd.
until after he was arrested."
But Danyell Herbert, upon his Oath, did justify,
That he told the said Thomas Rownd that he was
Servant to the Earl of Midd. when he arrested him;
yet notwithstanding he carried him to Prison."
Hereupon it is ORDERED, That the said Danyell
Herbert be discharged forthwith of his present Imprisonment; and that the aforesaid Francis Grimes and Thomas
Meade shall have the Admonition of this House, not to
commit the like Offence for the future, and then be
released from their present Restraint.
And further it is ORDERED, That the said Thomas
Rownd shall remain in the Custody of the Serjeant at
Arms attending this House, until the further Pleasure
of this House be known.
Adjourn.
