Prayers.

REsolved, &c. That a Thousand Pounds of the Four thousand Pounds, to be raised out of the Excise, and designed for the Yorkshire Horse under Colonel-Major Poynts, shall be allowed for Pay of the Regiment of Horse under the Command of Colonel Thornhagh, that are to be employed upon this present Design of pursuing the Enemy: And that a Thousand Pounds more shall be charged upon the Receipts of the Excise, to be paid, in its Course, with Interest after the Rate of Eight Pounds per Centum for the Forbearance of the same, to make up the first Ten thousand Pounds formerly designed for the Yorkshire Forces: And that Sir Tho. Widdrington do bring in an Ordinance to this Purpose.

Mr. Recorder reports the Amendments and Instructions to the Ordinance for appointing a Comptrol upon the Excise: The which were twice read; and assented unto: And the Ordinance, with the Amendments, passed; and the Instructions likewise passed, upon the Question; and ordered to be sent unto the Lords for their Concurrence.

Ordered, &c. That it be referred to the Committee of Lords and Commons for Excise, to consider of some Course, and some Expedient, for the keeping up and preserving the Credit of the Excise.

An Ordinance for explaining and declaring the Intention of the Lords and Commons, in the Ordinance for Sequestrations, for allowing a Fifth-Part to the Wives and Children of Delinquents, was this Day read the First and Second time; and, upon the Question, passed; and ordered to be sent unto the Lords for their Concurrence: And sent to them by Mr. Knightley.

Mr. Knightley carried to the Lords, for their Concurrence, the Ordinance for appointing Friday come Fortnight to be a Day of Publick Humiliation in the Parliament's Quarters: A like Ordinance for appointing Friday next to be a Day of Publick Humiliation within the Lines of Communication: The Ordinance for charging Fifty thousand Pounds upon the Excise, in Course, with Interest for the same, for Sir Thomas Fairefaxe's Army: The Ordinance for giving Power to the Committee of both Kingdoms to issue Commissions for Martial Law: An Ordinance for charging Two hundred Pounds upon the Excise, in Course, for Colonel Whaley, Captain Lawrence, Captain Canon, Captain Browne, and Lieutenant Disher, for furnishing them with Horse and Arms: An Ordinance for the Providing of Two serviceable Horses for Colonel Thornehagh, to be paid for by the Committee at Haberdashers-Hall.

He was to put the Lords in mind of the Ordinance for Sale of Papists and Delinquents Estates.

Ordered, &c. That Mr. Samuel Browne do bring in an Ordinance for disposing all the Fifth-Parts that shall be taken from the Wives and Children of Delinquents, and distributing it to the Wives and Children of such as have lost all their Estates in the Parliament's Service.

A Message from the Lords, by Doctor Aylett and Doctor Heath;

The Lords have commanded us to bring unto you this Order concerning Captain Wm. Batten: In which they desire your Concurrence. They desire your present Concurrence in the Ordinance, sent about Two Months since, concerning Mr. Porter, a deserving Minister of Plymouth; being a Matter of mere Justice.

An Ordinance for making Captain Wm. Batten Governor of Batten's-Tower, and Batten's-Mounts, near Plymouth, was this Day read the First and Second time; and, upon the Question, committed unto the Members of this House that are of the Committee for Plymouth: And they are to meet upon it this Afternoon.

Resolved, &c. That this House doth approve of the Exchange of Lieutenant-Colonel Hammon and Captain Briers, Prisoners to the Parliament, for Lieutenant-Colonel Kinkin and Captain Mathew, Prisoners to the King's Forces: And that Lieutenant-Colonel Hammon have Liberty to go, upon his Parole, and such Security as the Committee for Prisoners shall think fit, to effect his Exchange, accordingly.

Ordered, &c. That, on Thursday next, peremptorily, the first Business, the Ordinance concerning the Cloth sent by Mr. Davies into the Scotts Army in Ireland; and the Instructions for Sir Robert Kinge and Mr. Onslowe; be taken into Consideration: And that Mr. Speaker put the House in mind hereof.

Answer returned by the same Messengers; That this House hath considered their Lordships Message; and will send Answer by Messengers of their own.

Ordered, &c. That, on Saturday next, peremptorily, Mr. Scawen do report the Business concerning Debentures to Officers.

Ordered, &c. That the Ordinance for continuing the monthly Assessments for Sir Thomas Fairefaxe's Army for Six Months longer be forthwith printed.

A Letter from Colonel Edw. Massey, from Bridgwater, of Augusti 30; and a Letter intercepted from General Goringe to Secretary Nicholas; were this Day read.

An Ordinance for securing, out of the Receipts of the Excise, Four thousand Pounds, advanced by the Commissioners of Excise, and Mr. Edward Ashe, and to be paid to Colonel Wm. White, for the Service of the Northern Horse that are to come to the Assistance of Sir Thomas Fairefaxe, being Part of the first Ten thousand Pounds designed out of the Excise, for the Forces of the Northern Association, was this Day read; and, upon the Question, passed; and sent unto the Lords for their Concurrence, by Mr. Nicoll.

An Ordinance for securing, out of the Receipts of the Excise, Two thousand Five hundred Pounds, Part of the Thirteen thousand Pounds formerly granted out of the Excise to the Eastern Association, and advanced by the Commissioners of Excise; to be employed for Pay of Five hundred Horse to be upon the Borders of the Eastern Association, for the Defence thereof; was this Day read; and, upon the Question, passed; and sent unto the Lords for their Concurrence, by Mr. Nicoll.

Resolved, &c. That a Conference be desired with the Lords, so soon as may stand with their Lordships Conveniency, concerning the speedy Passing of the Ordinance for the Sale of Delinquents Estates.

Sir Henry Mildmay is appointed to go to the Lords, to desire this Conference.

Mr. Bond is appointed to go to the Messenger from this House, now sent to the Lords, to acquaint him, That he is ordered to desire the Lords to sit To-morrow, in regard of the many great Businesses.

Mr. Sollicitor, Mr. Lisle, Mr. Browne, Mr. Prideauxe, Sir Arth. Haselrigg, Mr. Pury, and Sir Peter Wentworth, are appointed Managers of this Conference.

Ordered, &c. That it be referred to the Committee of both Kingdoms, to take into Consideration, What further Forces may be speedily sent to the Assistance of Sir Thomas Fairefaxe, either out of the City of London, or out of any of the Counties; and how, and upon what Conditions.

Ordered, &c. That, To-morrow, the next Business after That of the Church, the House do proceed to consider of a Course, How to raise a Foundation of Monies: And that no other Business do then intervene.

Ordered, &c. That Sir Arthur Haselrigg do make the Report in his Hands on Thursday Morning; and the Ordinance concerning Leicester.

Mr. Knightley brings Answer from the Lords, That, as to the Ordinance concerning the Sale of Delinquents and Papists Estates, which he was to put the Lords in mind of, they will send Answer by Messengers of their own: They will likewise send Answer, by Messengers of their own, to the Ordinance for enabling the Committee of both Kingdoms to grant Commissions for executing Martial Law in the several Counties: And, as to the rest of the Ordinances carried up by him to the Lords, they do agree.

An Ordinance to enable the Committee of Wiltes, Dorsett, Devon, &c. with further Power for inquiring into, and redressing and remedying, the Grievances in those Counties, sent from the Lords, was this Day read the Second time; and, upon the Question, committed unto Mr. Sollicitor, Mr. Prideauxe, Mr. Lane, Sir Hen. Heyman, Mr. Gourdon, Sir Walter Erle, Mr. Poole, Sir Wm. Lewes, Sir Arthur Haselrigg, Captain Skinner, Sir John Bamfield, Mr. Hill, Sir Tho. Widdrington, Mr. Bond, Sir Edw. Baynton, Mr. Lisle, Colonel Morley, Mr. Blackeston, Mr. Corbett, Mr. Sam. Browne, Mr. Ashhurst, and the Knights and Burgesses of the Western Counties: And they are to meet upon it this Afternoon at Three of the Clock, in the Star-Chamber: And have Power to send for Parties, Witnesses, Papers, Records, &c.

Ordered, &c. That it be referred to the Committee of Accompts, to take and perfect the Accompts of John Lawrence Girdler, to whom the Parliament is indebted great Sums of Money.

It is further Ordered, That the Committee of Lords and Commons for Advance of Monies, at Haberdashers-Hall, do pay unto the said John Lawrence, upon the said Accompt, an Hundred Pounds per mensem, till the said Debts, appearing to be due unto him upon the Making up and Perfecting of the said Accompt, shall be satisfied.

The Lords Concurrence to be desired herein.

Ordered, &c. That the Sequestration of the 'State of Sir John Boteler be suspended for Thirty Days: And that the Goods seized on, or carried away, by the Committee of Hertfordshire, be brought back again to his House, and secured there, in the mean time.

Mr. Nicoll brings Answer from the Lords, That they do agree to the Ordinances for securing Four thousand Pounds, out of the Excise, for the Yorkshire Forces; and Two thousand Five hundred Pounds, out of the Excise, for the Forces of the Eastern Association.

Ordered, &c. That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, for the new Election of a Burgess for the Town of Aye in the County of Suffolk, in the place of Sir Frederick Cornewallis; he being disabled, by Judgment of this House, to sit here as a Member, this Parliament.

Ordered, &c. That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, for the new Election of a Burgess for the Borough of Dunwich in the County of Suffolk, in the place of Henry Cooke Esquire; he being disabled, by Judgment of this House, to sit here as a Member, this Parliament.

Ordered, &c. That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, for the new Election of a Burgess for the Borough of Sudbury in the County of Suffolk, in the place of Sir Robert Crane, deceased.
