Came's Petition referred to Judges.
Upon reading the Petition of John Came and Barbara
his Wife; praying Leave to bring in a Bill, for making
good the last Will of Barbara Opie, so far as it concerns
a Devise of a Farm in the Petition mentioned, towards
a Provision for the Petitioner Barbara Came; all Parties
concerned, as alledged, being consenting:
It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition shall
be, and is hereby, referred to Mr. Justice Tracy and Mr.
Baron Price; who are forthwith to summon all Parties
who are to be concerned in the Bill; and, after hearing
them, to report to the House the State of the Case, with
their Opinion thereupon under their Hands, and whether all Parties concerned in the Consequences of the
Bill have signed the Petition.
Ensworth versus Griffith.
Upon reading the Petition and Appeal of William
Ensworth and Katherine his Wife, Executrix of John
Lloyd Gentleman, deceased, and Edward Lloyd, Son
and Heir of the said John Lloyd, by the said William
Ensworth, his Prochein Amy, from a Decree made in
the Court of Exchequer, the Eleventh Day of April last,
and the Confirmation thereof the Twentieth Day of June
last, on the Behalf of Mary Griffith Widow, and Nebemiab Griffith an Infant, Son and Heir, and also Executor of Walter Griffith, deceased; and praying, "That
the said Decree may be reversed and set aside, and a
Redemption and Account of the Premises directed;
and that all Proceedings upon the said Decree may be
stayed:"
It is Ordered, by the Lords Spiritual and Temporal
in Parliament assembled, That the said Mary Griffith and
Nehemiah Griffith may have a Copy of the said Appeal;
and shall and they are hereby required to put in their
Answer thereunto, in Writing, on Saturday the Fourth
Day of January next, at Eleven a Clock, and that
all Proceedings in the Exchequer upon the said Decree
shall be, and they are hereby, stayed.
Great Actions of the D. of Marlborough considered:
The House taking into Consideration the many great
Actions which the Duke of Marlborough has performed
in Her Majesty's Service, to the Honour of his Country,
and for the Good of the common Cause of Europe; and
being desirous to express the Sense they have of his
Merit, and to perpetuate the Memory thereof, by settling and continuing his Titles and Honours, and the
Precedency thereof, in his Posterity, in the most effectual Manner, by Act of Parliament:
Address for Leave to bring in a Bill, to settle and continue his Titles, &c.
Resolved, That an humble Address be made to Her
Majesty (who is the Fountain of Honour), "That
She would be pleased to signify Her Allowance for
bringing in a Bill for that Purpose; and that She
would graciously be pleased to let the House know, in
what Manner it would be most acceptable to Her Majesty, the said Honours should be limited."
Then the Lords following were appointed a Committee, to draw the said Address; (videlicet,)
