After reading the Petition of Thomas Horton, Respondent to the Appeal of John Harrington and others, relating to the Judgement of this House, made the Fourth
Instant, upon hearing the said Appeal:

of Thomas Horton, read this Day, relating to the
Judgement of this House of the Fourth Instant,
upon hearing the Appeal wherein John Harrington
and others are Appellants, and Thomas Horton
Respondent; whose Lordships, having considered
thereof, are to report to the House; (videlicet,)

the Prince's Lodgings near the House of Peers;

D Beaufort's Petition referred to the Judges.
Upon reading the Petition of Henry Duke of Beaufort;
shewing, "That, upon his Marriage with his now Dutchess, divers Manors and Lands, in the Counties of
Southampton and Middl'x, were settled, for raising Portions for the Younger Children of that Marriage, in
case there be a Son; and for Daughters, in case of
Failure of Issue Male; but it was agreed, that the
said Charges should be transferred to some Part of
his Estate settled by Act of Parliament; and that the
Estate in Southampton and Middlesex should be eased and
discharged from that Burthen; which cannot be effected
otherwise than by Act of Parliament;" and praying
Leave to bring in a Bill, for the Purposes aforesaid:
It is Ordered, by the Lords Spiritual and Temporal
in Parliament assembled, That the Consideration of the
said Petition shall be, and is hereby, referred to Mr. Justice
Gould and Mr. Baron Bury; who are forthwith to summon all Parties that are to be concerned in the Bill; and,
after hearing them, to report to the House the State of the
Case, with their Opinion thereupon, under their Hands,
and whether all Parties concerned in the Consequences of
the Bill have signed the Petition.
Leseck & al. Naturalization.
Upon reading the Petitions of Daniel Leseck and others,
and the Petition of John Beault and others; praying to
be added to a Bill of Naturalization:
It is Ordered, by the Lords Spiritual and Temporal
in Parliament assembled, That the Petitioners may be
added to a Bill of Naturalization now depending in this
House.
Countess Derby versus E. Derby, Privilege waived.
After reading the Order made the Seventh Instant,
upon the Petition of Elizabeth Countess Dowager of
Derby, complaining of the Privilege of the Right Honourable James Earl of Derby:
The Earl of Derby, in his Place, declared, "He would
voluntarily waive his Privilege, in all Suits whatsoever,
relating to the Petitioner the Countess of Derby."
Ensworth versus Griffiths.
Whereas this Day was appointed, for hearing of the
Cause wherein William Ensworth and Katherine his Wife
are Appellants, and Mary Griffiths and Nehemiah Griffiths Respondents:
It is Ordered, by the Lords Spiritual and Temporal
in Parliament assembled, That this House will hear the
said Cause, by Counsel, at the Bar, on Wednesday next,
at Eleven a Clock; and that the Cause appointed that
Day to be heard, and all other Causes and Business, shall
be removed, to come on in Course.

Fitch and others, referred to them, when the House
will please to receive the same."
Which Report being delivered; it was agreed, and
Ordered, That the same shall be read on Wednesday
next, at Eleven a Clock.
