the Name of John Digby, Kinght.
This Bill was exhibited by the Earl of Bristol.

A Petition exhibited by the said Carewe Raleigh was
also read; and the said Bill and Petition were committed to the Lords Committees appointed for the Bill
exhibited by the said Carewe Raleigh for his Restitution.

Earl of Sussex's Privillege. Brockett's Arrest.
This Day William Brockett, Servant to the Earl of
Sussex, was brought before the Lords, by the Sheriffs
of London, by Virtue of His Majesty's Writ of Habeas
Corpus, awarded by this House primo Maii. The which
Writ and Return being read; the Lords, considering
that he was arrested in Execution, contrary to the Privileges of Parliament, delivered him out of Prison. Et
exonerantur Vicecomites prædicti.
And whereas it appeared also, by the Return of the
said Writ, That the Goods of the said William Brocket.
were taken in Execution; their Lordships referred in
to the Committee for Privileges, to consider whether the
said Goods, so taken in Execution, are to be re-delivered
unto him also, by Privilege of Parliament.
Earl of Cleveland's Privilege. Bigott's Arrest.
The like Reference is made to the said Committee
for the Goods of Jeremy Bigott, Servant to the Earl of
Cleveland.
Walgrave Hospital, versus Baud.
Whereas it was signified this Day to the House, That
there was an Hospital founded in Walgrave, in the
County of North'ton, about the Time of King Henry
the Sixth, by a Blacksmith, and endowed with divers
Lands, in Walgrave, Hollcott, and elsewhere, which at
this Day are let at One Hundred and Forty Pounds per
Annum; and that the Evidences of the said Lands were
ever kept in a Chest placed in the said Hospital, until,
about Fifty Years since, the Lady Mallorye (sometime
Wife of one of the Lanes, Lord of the said Town)
violently brake up the said Chest, and took them away,
and kept the said Lands in her Possession, without taking
any Lease thereof, allowing notwithstanding somewhat
liberally to the Relief of the Poor of that Hospital,
as likewise did all the Lanes, and Mr. Sanders the first
Purchaser from Lane, whilst that Land was in their
Possession. But the said Town being since sold to one
Pagett, and from him to Baud, these last Purchasers
have seized upon the said Lands, and have now placed
only Six of their own Servants in the said Hospital,
allowing them no more than Twenty Shillings a-piece
per Annum, for which also they do them good Service.
The Lords this Day Ordered, That whereas Ferdinando and William Baud are already, by the Order of
this House, to shew Cause at the Bar why the Decree
in Chancery against Lane should not be altered, That
they do also, at the same Time and Place, shew by
what Right and Evidence they detain the said Lands
from the Poor People of the said Hospital; and also,
That such of the said Town of Wallgrave, and the
Places adjoining, as are able to witness this Wrong
done to the said Hospital, shall attend at the Hearing
thereof; and also that Mr. Serjeant Crewe, Mr. Noye,
and Mr. Glanvill, are desired by the Lords to be of
Counsel herein, out of their Charity, on the Behalf
of the said Hospital; and lastly, That Mr. Justice
Dodderidge and Mr. Justice Crooke shall peruse the said
Evidences, and direct as much as they hold convenient
and necessary to be shewed to the Counsel of the said
Hospital, and be ready to deliver their Opinions in the
Point unto the Lords, at the Hearing.

References concerning the Manner of answering of Lords of Parliament and touching the Goods of Privileged Persons.
1. Ordered, To be referred to the Committee for
Privileges, to consider whether a Lord of Parliament is
to answer upon Oath, or upon his Honour only.
2. It is also referred to the said Committee, to consider whether a Peer, having done his Homage once to
the King at His Coronation, may be compelled to pay
for Respect of his Homage, in respect of Lands held of
the King in Capite.
3. Whether the Goods of a Privileged Person (taken
in Execution during the Privilege of Parliament) ought
not to be delivered to the said Party by Privilege of
Parliament.
