THE Proposition offered by the Committee was read:
videlicet,
Amendment of the Petitions of Right.
The Petition to be altered thus:
"That no Freeman be (for not lending of Money,
or for any other Cause contrary to Magna Charta and
the other Statutes insisted upon, and the true Intention of the same, to be declared by Your Majesty's
Judges, in any such Manner as is before mentioned)
imprisoned or detained."
Ordered, Nothing returned to the House from this
Committee to bind or conclude any Man's Opinion, further than to be the Subject of a Debate To-morrow.
The Petition of the Countess Dowager of Dorsett
was read, in hæc verba:
Countess of Dorsett's Petition, touching her Claim to the Baronies of Clifford, Westmerland, and Vescy.
"To the King's most Excellent Majesty.
"The humble Petition of Anne Countess Dowager of Dorsett, late Wife of Richard Earl
of Dorsett, deceased, and Daughter and
sole Heir of George Earl of Cumberland,
Lord Clifford, Westm'land, and Vescy.
"Sheweth,
"That Henry Lord Clifford, Westmerland, and Vescy,
rightful Heir of Robert de Clifford, summoned to Parliament by that Name in the Eight and Twentieth
Year of Edward the First, as a Baron, which Henry
had also and enjoyed the Names, Stiles, and Dignities of Lord Westmerland and Vescy, all which he had
in Fee Simple, descended from his Ancestors; the
same Henry, by the late King Henry the Eighth, was
created Earl of Cumberland, to have to him, and the
Heirs Males of his Body issuing; after the Death of
the said Henry and Henry his Son and Heir, and of
George his Son and Heir, Father of the Petitioner,
without Heir Male issuing of his Body, the said Earldom descended to Francis Earl of Cumberland, Brother of the said George; and the Names, Stiles, and
Dignities, as well of Clifford as Westmerland and Vescy,
are descended to the Petitioner, and she of Right
ought to enjoy those Names, Stiles, and Dignities,
and by them be called.
"Yet so it is (may it please Your most Excellent
Majesty) that the said Francis Earl of Cumb'land hath
published, that the Name of Lord Clifford, and also
(as the Petitioner is informed) the Name of Lord
Vescy and Westmerland do pertain unto him; and Henry
Clifford, his Son and Heir Apparent, by the Name
of Henry Clifford, Chevalier, was summoned to this
present Parliament, and calleth and stileth himself by
the Name of Lord Clifford, and claimeth and useth
the Place of the Title of Lord Clifford, belonging as
aforesaid to the Petitioner, to her great Wrong and
Disherison.
"She therefore prayeth, That Your Majesty will
admit of her Claim of the said Stiles, Dignities, and Places, of Clifford, Westmerland, and
Vescy, that she and her Heirs may have and
bear those Stiles and Dignities, and use the
Place belonging to them; and to give Order
and Direction that the said now Earl of Cumb'land, and the said Henry his Son and Heir,
may from henceforth forbear to stile themselves by any of those Names; and she shall
daily pray, etc."
The King's Reference of it to the House.
CHARLES R.
"It is Our Pleasure, That the Lords Spiritual and
Temporal assembled in this Parliament, calling both
the Petitioner and the within-named Henry Eldest Son
of the Earl of Cumberland, and also the said Earl,
and examine the Contents of this Petition, and certify
Us what they think in Justice doth pertain; and
thereupon full Right shall be done to these Parties."
Witnesses in Connisby's Case.
The Parties underwritten are to be required to attend
the Committee for Petitions, on Tuesday next at Two
post meridiem, ad testificandum in the Cause of Sir
Francis Connesby, Knight, and to be sworn first in the
House, at Nine that Morning; videlicet, Tho. and
Eliz. Milles, Henry Davison, Tho. Woodward, Danyell
Saywell.
