The prior of Holy Trinity complains that John de Kyngeston owes him 56s. being two years in arrears with his rent of 28s. p.a. before the day of the suing out of the writ, 18 Feb. 1359; the messuage could not be distrained upon for a year and a day as gavelet according to the custom of the City; John summoned three times, essoined once and still he did not come; messuage with its appurtenances seized etc. John summoned to be at the next court of Common pleas, Mon. 18 Nov. 1359; the prior, by Alan Horwode his attorney, present against John; John de Chichestre one of the sheriffs by Robert Cone, his clerk, testifies that on Thurs. 14 Nov. he seized the messuage by the view of J. Ha(u)ekyn, Walter Strangray, William Wordon [f. 29] and John atte Wall, capper; John de Kyngeston summoned by J. Ferthyng and J. Cobbe to be at the next court but he did not come; the prior recovered the messuage against John de Kyngeston to hold for a year and a day as gavelet.

133. Common plea held in the Husting, Mon. 1 Feb. 1361.
At the Husting of Common pleas held 34 Ed. III Walter de Berneye, one of the sheriffs, was ordered to warn John de Kyngeston to be present this day to say why judgment of shartford (fn. 2) should not be passed against him concerning a messuage which he ought to return to the prior of Holy Trinity; which prior had recovered it by a writ of gavelet on 18 Nov. 1359; the sheriff by Robert Cone, his clerk, testifies that John was warned by J. atte Wall, capper, and William de Wymondyswold to be here at this day; the def. did not come; the prior recovers the messuage etc. to hold as shartford; John in mercy.

Composition made between Richard de Wymbisch, prior, and convent of Holy Trinity of the one party and Adam, prior, and the brethren of the Crutched Friars of the other party, that since the Crutched Friars hold a tenement in the parish of St. Olave by the Tower by rent service of 13s. 8d. p.a. within which the friars' church is to stand and also a cemetery, the which tenement extends along the king's highway on the north from the tenement [f. 33v] of John Priour to that of Constance de Stratford and on the south from the tenement of the abbot of Lilleshall to that of Roger Frowyk and at the east and west ends from the highway to the same abbot's holding, which church as yet undedicated measured in length, 26¼ ells and in width 9¼ ells and the cemetery, as yet unconsecrated 25 ells in length on the south and 18 ells on the north and 16 ells in width on the east and 14 ells on the west. As the Crutched Friars intend to have the church dedicated and the cemetery consecrated, they will and grant expressly that no prejudice shall be caused to Holy Trinity in respect of the rent which they agree to pay and that Holy Trinity shall be allowed to distrain for the same, if it is in arrears. Moreover the Crutched Friars grant that they will cause no obstruction to the path or means of entry and exit to prevent the prior and convent from freely entering to obtain the rent notwithstanding any legal pleas. Because Holy Trinity might be impeded by the dedication of the church and the consecration of the cemetery, the Crutched Friars grant that if this is so, then the official of the archdeacon of London for the time being to whom they willingly submit, faith having been pledged on the foregoing, shall, upon the oath of the proctor of Holy Trinity alone, compel them to pay the 13s. 8d. as often as it is in arrears by pronouncing sentence of major excommunication against the prior and of interdict against the church. Bequest by William Hynelond, rector of St. Olave, to Eustace Glaston(bury) and other parishioners and their successors for ever of all his tenements and appurtenances once of Benet Hakeneye which he had by gift of Henry Petipas, 'stokfisshmongere', that they and their successors shall hold the day of his anniversary in the church of Holy Trinity where his body lies buried, (fn. 18) as appears in the testament which follows, proved in the Husting (fn. 19) Mon. 22 Nov. 1372, bequeathing to Eustace, William Whetele and John atte Walle, the tenements for the object above-stated and to cause fifteen masses to be celebrated on the day of his anniversary for his soul, to distribute 2s. 6d. to the poor on that day, to spend 6d. on a peal of bells (pro clasico), 1s. for the dirge, 1s. in lights and 11d. for the saying of the psalter and all profits from the tenements, beyond the amount necessary for the reasonable maintenance of the property and above charges, to be devoted to the use of the nave (usui corporis) of St. Olave and to the improvement and maintenance of the books and ornaments of the said church and if the legatees or their successors fail in fulfilling the abovementioned duties or cease to observe the testator's anniversary for one whole year then the tenements to revert to the prior and convent of Holy Trinity to celebrate masses for his soul and under the terms of this will the parishioners pay 2s. 6d. p.a. dated 24 Dec. [?1372].
